MEDAN – Kepolisian Sumatera Utara (Polda Sumut) mengambil alih penanganan kasus penganiayaan yang menjadikan pedagang sayur di Pasar Gambir, Medan, Liti Wari Iman Gea, sebagai tersangka.
Hal itu terungkap saat Polda Sumut dan Polrestabes Medan menggelar konferensi pers di Polrestabes Medan, Sabtu (9/10/2021) malam.
Diperoleh informasi, terkait pedagang sayur, Liti Wari Iman Gea, yang sempat viral dianiaya preman bernama Beny CS di Pasar Gambir, Kecamatan Percut Sei Tuan ternyata dijadikan tersangka oleh pihak kepolisian dalam hal ini Polsek Percut Sei Tuan.
“Kami perlu sampaikan, bahwa pimpinan Polri dan Kapolda Sumut telah mendengar serta merespon cepat serta prihatin atas berita yang viral terkait penganiayaan dan penetapan tersangka kepada Liti. Dimana kejadiannya 5 September 2021 yang lalu,” kata Kabid Humas Polda Sumut, Kombes Pol Hadi Wahyudi didampingi Kapolrestabes Medan Kombes Pol Riko Sunarko di Polrestabes Medan.
Menurutnya, untuk meredam polemik yang terjadi di tengah masyarakat akibat penanganan perkara tersebut, maka Kapolda Sumut telah memerintahkan Direskrimum dan Kapolrestabes Medan untuk membentuk tim dan menarik penanganan perkara penganiayaan terhadap korban yang dilakukan oleh Beny.
Ditambahkan Hadi, proses penyidikan akan dilakukan oleh Satreskrim Polrestabes Medan. Sementara, tim yang sudah dibentuk ini juga diperintahkan untuk mengejar dan menangkap dua orang pelaku lainnya yang keduanya sudah diketahui identitasnya, yakni DD dan FR.
“Tim saat ini sedang mengejar dua pelaku lainnya yaitu DD, dan FR, kami menghimbau kepada kedua pelaku tersebut agar segera menyerahkan diri,” pinta juru bicara Poldasu itu.
Kepolisian meminta kepada dua pelaku untuk menyerahkan diri ke Satreskrim Polrestabes Medan. Dan, diminta kepada masyarakat untuk mempercayakan penanganan kasus ini kepada kepolisian.
“Dengan telah dilakukannya langkah oleh Kapolda tersebut kami imbau masyarakat untuk mempercayakan penanganan kasus ini kepada pihak polisi,” katanya.
Liti Wari Liti Wari Iman Gea sempat menuai simpati dari masyarakat setelah videonya dianiaya beberapa pria diduga preman di pasar viral. Seorang pria bernama Beny telah ditetapkan sebagai tersangka. Namun rekan Beny hingga kini tak kunjung ditanggap.
Mirisnya lagi, belakangan ternyata penyidik Polsek Percut Sei Tuan justru menetapkan pedagang sayur itu sebagai tersangka. Penetapan tersangka tersebut kembali menuai simpati dari masyarakat dan berbagai kalangan.
Bahkan, Lembaga Bantuan Hukum (LBH) Medan mempertanyakan penetapan tersangka pedagang yang dipukul oleh preman itu.
“Melihat kejadian sesuai dengan berita, tentu proses hukum memang harus dijalankan atas kedua laporan. Mengenai status tersangka terhadap Liti Wari, itu justru aneh,” kata pengacara LBH Medan, Maswan Tambak, Jumat (8/10/2021).
Ia menilai seharusnya Polsek Percut Sei Tuan tidak mengejar unsur pidana semata. Tetapi, penyidik harus melihat niat dari perbuatannya.
“Dalam proses ini seharusnya pihak Polsek Percut Sei Tuan cq penyidik tidak melulu mengejar unsur pasal melainkan harus melihat niat dari perbuatannya. Apakah ada niat jahat (mens rea) dari Liti Wari atau tidak. Bisa saja kita duga Liti Wari melakukan pemukulan atau perbuatan lain, tapi bisa saja perbuatan itu bermaksud membela diri,” ucap Maswan.
“Kalau keadaannya demikian tentu penetapan tersangka terhadap Liti Wari tidak tepat,” imbuhnya.
Dilanjutkan Maswan, dalam peristiwa tersebut, Liti Wari merupakan korban lantaran apa yang dilakukannya merupakan tindakan membela diri. Karena itu, menurutnya, penetapan tersangka terhadap Liti Wari tersebut tidaklah tepat.
“Dalam kejadian tersebut Liti Wari kan jadi korban, sehingga kalau ada perbuatan yang bersifat membela diri (dalam tindakan wajar dan sesuai) maka tidak tepat penetapan tersangka terhadap Liti Wari,” lanjutnya.
“Dalam konteks pidana, melihat niat jahat (mens rea) itu sangat penting. Jadi tidak melulu melihat unsur saja. Ya kalau orang niatnya membela diri kan wajar sepanjang pembelaan dirinya masih sesuai dengan kondisinya. Tapi kalau perbuatan si preman itu tentu niatnya jahat,” ucap Maswan. (JN/BTM)
