JELAJAHNEWS.ID – Mahkamah Konstitusi (MK) mendiskualifikasi calon Wakil Bupati Pasaman nomor urut 1, Anggit Kurniawan Nasution. Keputusan ini diambil setelah MK menilai Anggit tidak jujur mengenai statusnya sebagai mantan terpidana.
“Mengabulkan permohonan pemohon untuk sebagian,” kata Ketua MK Suhartoyo dalam sidang putusan perselisihan hasil Pilkada perkara nomor 02/PHPU.BUP-XXIII/2024 di Gedung MK, Jakarta Pusat, Senin (24/2/2025).
Dalam putusan tersebut, MK secara resmi menyatakan diskualifikasi terhadap Anggit Kurniawan Nasution sebagai calon Wakil Bupati Pasaman dalam Pemilihan Umum Bupati dan Wakil Bupati Pasaman Tahun 2024.
Alasan Diskualifikasi
Dalam pertimbangannya, Suhartoyo menyebut bahwa Anggit seharusnya bersikap terbuka mengenai statusnya sebagai mantan terpidana. Namun, ia justru membiarkan surat keterangan tidak pernah dipidana yang dikeluarkan oleh Pengadilan Negeri Jakarta Selatan tetap berlaku, meskipun kemudian dikoreksi oleh pengadilan tersebut.
MK menegaskan bahwa setiap calon kepala daerah wajib mengumumkan statusnya sebagai mantan terpidana kepada publik, meskipun hukuman yang dijalani kurang dari lima tahun.
Selain itu, MK juga menemukan bahwa Anggit berupaya menyembunyikan statusnya dengan tidak mengoreksi surat catatan kepolisian yang menyatakan ia tidak pernah melakukan tindak pidana. MK menilai bahwa Anggit seharusnya menolak surat tersebut karena dikeluarkan sebelum penetapan pasangan calon.
“Anggit Kurniawan Nasution seharusnya menolak dan secara jujur menyatakan bahwa surat keterangan catatan kepolisian tersebut tidak benar serta tidak sesuai dengan data pribadi yang sebenarnya,” ujar Suhartoyo.
Hal yang sama berlaku untuk surat keterangan dari Pengadilan Negeri Jakarta Selatan yang menyatakan bahwa Anggit tidak pernah menjadi terpidana. Menurut MK, Anggit seharusnya mengajukan keberatan terhadap surat tersebut karena tidak mencerminkan fakta yang sebenarnya.
KPU Diminta Gelar Pemungutan Suara Ulang (PSU)
MK menilai pencalonan Anggit sebagai Wakil Bupati Pasaman cacat hukum dan tidak memenuhi syarat. Oleh karena itu, MK meminta Komisi Pemilihan Umum (KPU) untuk menggelar pemungutan suara ulang (PSU) dalam waktu maksimal 60 hari sejak putusan dibacakan, tanpa mengikutsertakan Anggit sebagai calon.
“Mahkamah tidak ragu untuk mendiskualifikasi Anggit Kurniawan Nasution dari kontestasi Pemilihan Umum Bupati dan Wakil Bupati Pasaman Tahun 2024 serta memerintahkan Termohon untuk melaksanakan Pemungutan Suara Ulang tanpa mengikutsertakan yang bersangkutan,” tegas Suhartoyo.
Selain itu, MK juga memerintahkan KPU untuk menggelar satu kali debat terbuka antara peserta Pilkada sebelum PSU dilaksanakan. MK menyerahkan kepada partai politik atau gabungan partai politik untuk menentukan pengganti Anggit sebagai calon wakil bupati.
“Memerintahkan kepada Termohon untuk menyelenggarakan satu kali debat terbuka pasangan calon guna menyampaikan visi, misi, dan program sebelum pemungutan suara ulang,” tutupnya.(jn/**)
